Ultracker Aleta Controversy

Hi everyone.  In case you’re wondering why I haven’t posted, here’s why.  When I posted about the Ultracker Aleta the other day, I posted product photos from Ultracker’s website.  Unbeknownst to me, one of the Ultracker’s product photos used a background image that belonged to another photographer (using different equipment).

I was notified by a reader who recognized the image because he had collaborated with the photographer on it.  As soon as I saw his comment informing me about it, I immediately deleted the image from the article.  I also contacted Ultracker and they apologized and deleted the image from their website as well.

After I deleted the image, the photographer contacted me.  I explained the situation, let him know it was deleted and gave him the contact info for my contact at Ultracker.  I’m still trying to resolve it with him.  Anyway guys, I just wanted to let you know what’s going on.

  • In practical reality, unless the photographer is “world famous” (almost definitely not), the only issue is damages and how much, which in this case is probably zero – especially considering the potential cost of litigation that wouldn’t be worth anyone’s money.

Seems the photographer should find something else to worry about, now that the pictures are gone anyway.

And 360Rumors.com has absolutely no liability whatsoever, of course, under the DMCA.

      • I would not worry about it. If you’re served with papers, as someone else said, it’s covered by the DMCA. Plus, there’ the mitigating circumstance that you were using it from another company that should have gotten permission and the rights.
